Mr. Politician,this is my take.


Read the Draft constitution that has just been released in Kenya.

The draft, which many Kenyans have been waiting for has finally been released to the public, from this it will now take the peoples’ acceptance and parliament passing to make it the supreme law of the land.

Now the public is supposed to debate the draft and present its views withing 30 days.

Among the noticeable recommendations are the clipping of presidential powers and the introduction of a more powerful premier,this has caused a lot of friction between PNU (who want an imperial presidency) and ODM (Who are for a powerful prime minister),the argument from the PNU side is that if someone has to exercise executive authority he has to get a mandate from the Kenyan people,they claim one cannot exercise Executive authority when he/she was chosen by parliament,this is what leads me to the big question;Are these worries genuine or they are just a ploy to deny us a fair constitution?

The reason why I think the premier or presidential power is not contentious is because the same MP who chooses a Prime Minister was chosen by Kenyans, they chose him/her to represent them and if he/she in parliament chooses another national leader he has executed the mandate of the people, in simple language it is the people from the ground who have made that choice so it will be very imprudent for a learned friend to stand up say that a Prime Minister chosen by parliament cannot exercise executive Authority because he wasn’t chosen by the people of Kenya.Instead they should be using extra energy in discussing the empowerment of institutions in Kenya to curb misuse of powers by whoever will be in office.

It is very wrong for anyone to discuss this draft while referring to our current government set up,and it is very sad when the people engaging in this uninformed debate are educated people who are supposed to have the interest of the nation at heart,they are busy using the differences between Prime Minister Raila Odinga and President Kibaki to approach the draft debate,what they don’t know is that the next constitution will not have them in their respective offices, it is highest time our leaders talked about issues the way they are, it is highest time we had concern with our institutions rather than the persons holding the offices in our institutions,this i say because there are some other people who will debate the draft while thinking that Raila Odinga will be the next Prime Minister or Kibaki the next president thereby struggling to safeguard the office of their assumed leader.

What i must say i like about this draft is that it has measures good enough to keep both the President and the PM who share Executive power in check.It has given Parliament and the Cabinet enough avenues and power to fire any of them which is as good as a secure system because the PM can be sacked by Parliament, through a vote of no confidence, which the President ratifies within a week and the same applies to the president.

So once again I ask those politicians who think they are more learned to interpret the draft constitution for the rest of the Kenyan people to shelve their ego because we can read the draft on our own and understand it as it is because it is more simplified that previous drafts,i also state again that the system of government doesn’t matter and i have no problem with anyone being given executive powers what am worried about is that;will our legislators put politics aside and give Kenyans the constitution they have been waiting for,for more than 20years?

Upholding human rights while confronting climate change

Unless states take prompt, adequate action to address its effects, climate change could become a major threat to the realization of human rights, with those already living in poverty feeling the effects sooner and more acutely.

As global attention turns to the upcoming round of climate change negotiations in Copenhagen in December, it is more essential than ever to bring human rights to the table.

Observed and projected changes attributable to climate change include the contraction of snow-covered areas; shrinking of sea ice and melting of polar ice caps; rise of sea levels; increased frequency of hot extremes and heat waves; increase in areas affected by drought; and increased intensity of tropical cyclones.

There is an intrinsic link between such environmental impacts and the ability to realize a range of human rights. State failure to act effectively to curb climate change could result in widespread violations of the right to life, right to health, right to water, right to food, and the right to housing. Acute water shortages and decreased crop yields in the poorer region of the world, to take just two examples, would undermine the rights of millions of people.

State responses to the threat of climate change must ensure that human rights are protected. Strategies for adaptation (preparing for the foreseeable adverse effects of climate change) and mitigation (slowing climate change and reducing its harmful effects) must be firmly rooted in a human rights analysis of the legal obligations of states. Amnesty International believes that the following rights and principles must be an integral part of efforts to address climate change:

* Non-discrimination: The effects of climate change will be felt disproportionately by those who are also vulnerable to human rights abuses because of their poverty, age, gender, race, ethnicity, disability or other status. Climate change policies must not discriminate and must ensure protection against discrimination, particularly of the most vulnerable groups.


* Freedom of information: Access to information is critical to addressing climate change. States must promote and facilitate the flow of information on climate change and measures taken to address it. States have a duty to disseminate information about environmental risks.


* Right to active participation: States must conduct adequate and meaningful consultation with affected people, involving them in decision-making on the policies that would shape their lives. States must ensure participation of civil society, including representative of vulnerable groups, in the design of national adaptation and mitigation strategies


* Rights to freedom of expression, association and assembly: The right to peacefully protest against government action or inaction in relation to climate change is a crucial safeguard that must be respected and protected. Individuals must enjoy the right to seek, receive and impart information and ideas, and must not be persecuted or otherwise harassed for exercising these human rights.


* Accountability and the right to effective remedy: Where states’ actions and omissions in relation to the impacts of climate change result in human rights violations, victims should have access to an effective remedy.

Why John Githongo Remains the Best Option after Ringera




When John Githongo served the president, he did his work with utmost commitment, in my life, I have never seen a public servant like Githongo, am not just praising John for the love I have for him or because he is one of my role models but for what he stood and still stands for.

If you don’t know John Githongo, He studied Economics and Philosophy at the University of Wales before returning to his native Kenya. He briefly worked as a management consultant and researcher before moving into journalism. In this role he wrote extensively for the East African attacking corruption throughout Kenyan society under the Moi regime, this was way before he had been employed by Kibaki.

He is the pioneer of the Kenyan chapter of Transparency international, a non-governmental agency devoted to fighting corruption, before going to exile John Githongo was President Kibaki’s chief adviser on the war on corruption in his capacity as the Permanent Secretary in charge of Ethics and Governance Department.

That is just a bit of his background, now let us dwell a little on facts, if you read through the “Githongo Dossier” the Githongo report on the Anglo Leasing Scandal, you will find a lot in this man, you will comment on his ability to back his findings with substantive evidence, you will also commend on his bravery to name implicated ministers and influential persons by name without censoring any in fear of victimization.

I for one appreciate his work unlike many other reports which are full of allegations advised by tribal under hands. He stood his ground when all the powerful people were closing in on him, he even could not be intimidated by Kibaki’s Kitchen cabinet who were out to buy him off, at one time he was even frustrated by the then Anti Corruption Head,Aaron Ringera.

In his activities, Githongo has created enemies in his back yard, although some of them are very proud of their straight forward son. Many of them claimed he was fighting his own people forgetting that there was always a first time for everything.

When the post of the Director of The Kenya Anti Corruption Commission was in dispute I was privileged to have a conversation with John Githongo, I remember asking him if he would apply for the Job if Parliament annulled Ringera’s reappointment, he told me he was not going to comment on that, from this I figured out that my friend was saying “lets wait and see” as much as there is pressure piling on him to take the Job, it remains his decision to do or not to do so.

But if you were to ask of my opinion, I think naturally all Kenyans are in need of his stewardship therefore John will be doing us a great service by applying for the job because Kenyans can trust him in that job more than they can trust any living civil servant.

When he was interviewed by the Standard on the 06/02/2009 he never regretted his move to fight the strong and mighty I remember him saying answering ”No. I don’t feel dejected. This is a long haul struggle fraught with victories and setbacks too. By 2007, corruption had started to change into an offshoot of a new energetic kind of matatu corporatism; corruption wore a suit and traded on the stock exchange via holding companies; invested in middle class urban villas and the like.

Shenanigans with regard to the privatisation of public assets and brazen conflict of interest with regard to participation in share flotation”.

This was after being questioned whether he was dejected because his tape recordings never had a big impact in his fight on corruption.

From his answer I see a man who calls corruption what it is without hiding behind money bags, I see a man who saw through shoddy deals that defraud the Kenyan Public their resources without worrying whether he was implicating his tribesmen, in John Githongo I see a man who can head The Kenya Anti Corruption Commission with the devotion that is needed period!

I quote John Githongo’s words “The war is not lost but important battles have been lost. What is happening today is not so much a failure in the fight against corruption but a reverberating failure in leadership”

I rest my case.

STAND UP FOR AFRICA





The phenomenon of forced evictions in Africa is a massive human rights scandal that should be stopped immediately. Instead of taking measures to improve the housing and living conditions of people, particularly those living in poverty, many governments are driving people further into poverty by forcibly evicting them from their homes and communities without any alternatives. As long as governments are not held accountable, people will continue to be vulnerable to this gross violation of their human rights, with catastrophic consequences for their lives. We call on African leaders to help bring an end to these human rights violations.

Murder 'followed Facebook status change'




A mother-of-four was murdered by her partner days after she changed her Facebook status from "married" to "single", a court has heard.

Hayley Jones, 26, was found by her children at the family home. She had been fatally stabbed.

Cardiff Crown Court heard that Brian Lewis, 31, killed her after telling friends he could not stand to lose her to another man.

Mr Lewis, of New Tredegar, Caerphilly, denies murder.

The prosecution claims Mr Lewis strangled and stabbed his partner at their home in the Phillipstown area of the town on 12 March.

On 2 March, she changed her Facebook relationship status from married to single and she made it clear their relationship was over

Mark Evans, prosecuting, told the court the couple, who were not married, had been "teenage sweethearts" since Ms Jones was 13, and had described themselves as married.

He said: "Hayley started to expand her social life and was spending a lot of time on internet sites, in particular Facebook.

"She was quite secretive about this, preventing Lewis from using the site and turning the computer off. It is quite clear this rankled with him.

"On 2 March, she changed her Facebook relationship status from married to single and she made it clear their relationship was over."

The court heard that after Mr Lewis lost his job, creating a downward spiral on the family finances, Ms Jones took up work as a care assistant.

Ms Jones was described as a "devoted mother" to the couple's four children, aged between three and 10.

The jury was told that Mr Lewis feared their relationship was on the rocks because of the time she spent online.

The court heard Mr Lewis had threatened to kill his partner rather than lose her to another man.

Mr Evans added: "But Lewis told police the only tension between him and Hayley was the use of the home computer."

The court heard Mr Lewis attacked Ms Jones with a kitchen knife at 0400 GMT as she was sleeping on the settee at their home, stabbing her through three layers of clothing and two sleeping bags.

He then dialled 999 and told police to come to the house but fled the scene, leaving the couple's four children to find their mother's body.

Mr Lewis later gave himself up at Blackwood Police Station, the court heard.

The trial continues.

Lake Turkana is home to large populations of Nile crocodiles, hippos, and over 40 different species of fish and venomous snakes and must be protected.




Globally there has been an increase in concern over the environmental degradation and the need for greater environmental protection and management.

All ecosystems of the world are potentially affected by man’s activities, but wetlands are especially fragile and often neglected. Wetlands are neither well understood nor appreciated and have been increasingly under natural and human pressures in all parts of the globe and especially in Africa.

The GIBE III project is one of a series of damming projects that have been undertaken by the Ethiopian government. The Gibe III hydroelectric project on the Omo River is a public-private partnership planned as a 25year national energy master plan of Ethiopia. The planned increase in power generation, however far exceeds domestic needs with the surplus which is estimated at fifty percent being exported to the neighboring countries including Kenya which the Ethiopian Electric Power Company (EEPCo) predicts to export 500MW to.

The Omo River is a transboundary river that contributes at least 80 percent of the waters of Lake Turkana. Its terminus is at northern end of Kenya’s Lake Turkana, and most of the Omo Delta is in Kenya. A sharp reduction in the Omo’s downstream flow volume would cause a significant retreat of Lake Turkana.

An assessment of the overall impact of the proposed Gibe III project on the Lake Turkana, in Kenya must begin with the direct impact of the reduced flow into the lake, since the Omo River is the major source of water for Lake Turkana. Reduction in flow volume from reservoir filling would be the primary impact.

Based on a combination of calculations from satellite imagery, and published flow data, it is reasonable to say that the effect of the flow on the Lake Turkana can be established. Therefore, concluding that over the first five years, there would be a loss of about 53.5km3 of water from the lake, corresponding to a drop of about 7 meters. This should be considered as a conservative estimate: an alternative estimate, based on other available data is 10meters.

Using bathymetric data for Lake Turkana, it is possible to predict that the Omo delta and the northern section of the lake will desiccate, and the shorelines would recede to almost the halfway point, southward along the lake. A salinity increase in the lake is likely to severely affect the aquatic salinity of the lake which is already barely portable. Concentrations of the ions in the lake will. The effect of this is increased concentration on fish populations and on the usefulness of the lake for watering livestock and for human consumption will need to be determined. In turn the region’s livelihood systems-particularly those of the Turkana, Dassanech, Rendille., Samburu and other groups in Kenya would be significantly impacted as they are dependant upon recession cultivation, lakeside livestock grazing and watering at the lake, and fishing.

The Omo Delta and northern shoreline area have long provided habitat for a unique abundance of hippopotamus and Nile crocodile, with extraordinary numbers of water birds. This entire area would be the first part of Lake Turkana to undergo major destruction of habitat and wildlife. Consequently, the unique floral and faunal systems of Lake Turkana would likely be threatened with major destruction. The lake is now internationally recognized, including as a World Heritage Site for its abundance of wildlife, as well as unique floral and fauna species-many of which are barely described or understood, from an ecological perspective.



Friends Of Lake Turkana (FoLT)

FoLT is currently undertaking a campaign to highlight the possible dangers posed on the lake and its eco-system due to the Gibe III damming project being undertaken by the Ethiopian government in its quest for energy development both for domestic consumption and for export to neighboring countries of Djibouti, Sudan and Kenya. FoLT is working to bring attention to the impacts which Gibe III Dam will have on the Lake Turkana region and peoples and to find lasting solutions to this social injustice.

FoLT does not to totally disregard the idea of producing hydroelectric power, but would like to encourage pursuit of alternative forms of energy development that avoid unacceptable trade offs which jeopardizes indigenous economies and destroy the eco-system. For example the formulation of a program of small dams, with fundamental attention on the maintenance of maximum river flow, or a slow in the filling up of the dam to allow for adequate flow of water into Lake Turkana rather than drastic five year filling up plan currently in place. Mexico: Indigenous woman accused of kidnapping six agents named prisoner of conscience

Amnesty International today adopted 46-year-old Jacinta Marcial as a prisoner of conscience for being unfairly sentenced to 21 years in prison and demanded that the Mexican authorities release her immediately and unconditionally.

The organization said she has been denied a fair trial and is in prison solely due to her marginal status in society as a poor indigenous woman with limited access to justice.

Mother of six Jacinta Francisco Marcial, an Otomí Indigenous woman from Santiago Mexquititlán, Querétaro state, has been held in the Centro de Readaptación de San José El Alto prison since August 2006. She is charged with the kidnapping of six agents of the Mexican Federal Investigation Agency. The agents claim they were held hostage by Jacinta and other market stall holders during a raid on pirate DVD vendors on Santiago Mexquititlán square in March 2006.

"Jacinta's case is a scandal," said Rupert Knox, Mexico Researcher at Amnesty International. “This is a travesty of justice and a clear example of the second class justice Indigenous People often receive in Mexico.”

“Jacinta’s story shows how the Mexican criminal justice system is being misused to unfairly prosecute the most vulnerable. She has been targeted because of her ethnicity, gender and social status,” said Rupert Knox.

On 26 March 2006, six plainclothes agents of the Federal Investigation Agency entered the main market in Santiago Mexquititlán. They claimed to be carrying out an operation to locate drugs and pirate DVDs. Tensions were raised as the agents tried to confiscate goods and vendors punctured some of the agents’ car tires.

According to the community, the protest ended that same day after the Regional Police Chief went to a neighbouring town to collect money to compensate the vendors for the damage to their merchandise. That evening, the six agents filed a complaint with the Federal Public Prosecutor, alleging they had been kidnapped for several hours by the protestors.

More than four months after the event, on 3 August 2006, Jacinta was arrested and taken to the Federal Attorney General’s Office. At the time she was told she was going to be questioned about the felling of a tree but only when she was taken to prison did she find out that she was being accused of kidnapping the agents, along with two other women.

The only evidence against Jacinta was a photo in the local newspaper taken when she was walking behind the crowd of protestors. In their original statements on 27 March 2006, the federal agents made no reference to Jacinta Marcial. Only a month later, when shown the photo from the local newspaper, did the agents accuse Jacinta of involvement in the alleged crime. No other evidence to prove her involvement was ever presented and the federal agents were never required to appear during the trial proceedings to substantiate their claim or confirm her identification.

At the time, Jacinta spoke very little Spanish and did not understand what was happening. She was not provided with an interpreter and the state-appointed public defender never spoke to her to explain her rights or defence. Jacinta said he just sat down in the corner of the room and said nothing while she was pressed to sign papers she did not understand.

Speaking with an Amnesty International researcher who visited her in jail, Jacinta said: “The first night in my cell it was raining and it was very cold with the bars open onto the main courtyard and at that moment I felt bad because I knew that I hadn’t done anything wrong and I was in prison. And yes, I started to cry, I cried and I asked myself “what now?” And when I heard doors opening I thought perhaps they’ve come to let me out, and I would stand up and look through the bars to see if someone was coming to let me out, but they never did.”

On 17 July 2009 the National Human Rights Commission concluded that there were serious irregularities and fabricated evidence in Jacinta’s case. Jacinta remains in prison pending the outcome of a retrial.

A population census is the process of collecting,compiling,evaluating,analysing and publishing demographic,social and/or economic data pertaining to all persons in a country or a well delimited part of a country.


On the night of August 24th 2009,Kenya will hold its fifth National Population and Housing Census as an independent country.

Since 1969,kenya is among the few countries in Africa that have carried out a population and housing census every ten years.

The census provides us with a window to our current realities and provides us with the information we require to embrace the challenges and opportunities that lie ahead.

The counting of people is a universal exercise and virtually every country in the world carries a census albeit in varying intervals.

Information gathered from the census is an integral requirement for the development planning process and management of the affairs of a country.The statistics will tell us of our current status and can be used to provide information on how we can move on where we intend to go.

The census data is useful to the private sector for appraising market conditions and for making informed investment decisions.For example it is important for estimating customer demand which depend among other factors,on size,composition and geographical distribution of the population.The census data is also widely used in conducting social and economic research.

IMPORTANCE OF THE CENSUS

The censs provides a statistical snapshot of our country and its people.A vast majority of all countries regularly carry out a census to collect important information about the social and economic situation of the people living in its various regions.


CONFIDENTIALITY

All information collected will be confidential and used for planning and research only.All census officials will swear an "Oath of secrecy"as embodied in the Statistics Act 2006.The Oath forbids census officials to divulge the information collected to unauthorized persons.

ETHNIC AND RELIGIOUS COMPOSITIONS

Yes,information on tribe/ethnicity will be collected due to its statistical and cultural value.
The value lies not so much in the numbers,but in the label/attribute.Ethnic origin data paint a picture of Kenya's cultural diversity and provide insight into the changing in-migration patterns and increasing diversity.Governments,community groups,ethnic and cultural organizations,school boards,hospitals,and researchers use ethnic data to assess the
social-economic characteristics of people of different backgrounds.


A number of quality assurance measures are in place to ensure complete and accurate information is collected.Qualified and well trained senior supervisors and supervisors will will control quality at the field level,while experts and key stakeholders from vrious census committees will oversee the exercise nationally.Additionally,an independent team of experts in census taking is expected to monitor the exercise nationally.

Household members will be asked some questions about their relatives living abroad.

RELEASE DATE

It is expected that preliminary results will be released by end of December 2009,with full reports on the various aspects of the census expected in the next year.

ON THE DAY

Time:
Counting of people will start on the night of 24th August 2009 and continue upto 31st August when counting is scheduled to end.People will be counted with reference to where they spent the night of the 24th August.

It is expected that enumerators will spend about 30minutes in each house,though this may be shorter or longer depending on the size of the household.

Security:
The security agencies are fully involved and are part of the national and district census committees.Enumerators will have official identity cards and T-shirts for ease of identification.Also they have been recruited from where they live therefore,they are people who are known by the locals.Enumerators will also be accompanied by village elders or headmen who are well known by the households.

If you are not counted:
It may not be possible to reach everyone everywhere on the night of 24th August.The census teams will proceed with enumeration throughout the week,but all information will refer to the night of 24th August-census reference night.Those not enumerated by August 31st should report to the local provincial administrative office.However care must be taken to ensure that you have indeed not been enumerated.It is not uncommon for members who are momentarily away from their households to be enumerated in absentia.

I need my Kenya:The TJRC (Truth Justice and Reconciliation commission) and the Hague


Retired President Moi has warned that the Truth Justice and Reconciliation Commission could divide the country.He further argues that “Kenya is not South Africa, and the public may be unable to handle the fallout from divisive issues of land and past skirmishes,”

This is just one among the many arguments put for or against the formation of the TJRC as compared to the Local special tribunal and vise versa.

Okay,some strongly claim justice can only be achieved through the Hague route,this term Justice is being too complex to be understood by many,for example the dwell on Restorative justice and Retributive justice,they forget Justice as a whole cannot be conclusively achieved if all its four aspects are not taken into account.

I stood against the Hague because there is no way on earth Retributive justice can heal a nation,believe me you it will just open new enemy patterns and this is dangerous in a country that is plunged with a very high level of economic inequality (this is mostly the catalyst to major conflicts).
Even the Special courts would have been a better bet than the Hague if only our legislators had agreed to amend the clauses that encouraged Impunity in the Executive.

So what?

Do we need Retributive justice,Restorative justice,Procedural justice or Distributive justice?

I would say If you have been wronged, consider carefully what kind of justice you are really seeking.

If you are the wrong-doer and others are seeking justice against you, seek first to ensure distributive justice.

A question may be asked why people are put in prison. If it is to prevent them re-offending, then it is restorative justice. If it is to punish them, then it is retributive justice. Sadly, this has proven a poor method of prevention of injustices because it is not clear what role it plays.

At the end of the day,we Kenyans are to blame,the law is there,we knew the law had been broken and we accepted the status quo,in Signing the National accord,Raila or Kibaki never signed it for Duncan Mikae or you,they signed it to reach a compromise,this accord was a law made to cover a breaking of a another Law (stolen elections),I don’t say this was bad because at the end of the day it was the most honourable thing they did because it saved lives,so my point is we accepted to have the two principles and we also accepted to live together.

That was then,so if anyone comes up now and wants to convict a post poll violence financier or whoever,this person is not relevant in my eyes,to me it seems he or she wants to overwrite the National accord and assume that Kenya was a peaceful state or he or she wants to break down the government because it is only after we accept that the Kibaki presidency is an illegal one and the coalition government an extra unwanted government that we can now stand up to prosecute reprimand and do anything with the “so called” post election architects.

To me Kenya needs Reconciliation efforts that are geared towards reducing or killing of the hatred that we saw in 2007/2008,I don’t see why the TJRC mandate should be changed to give TJRC prosecutorial powers or any other powers that can make it another court or police department,we also don’t need the Hague or the special tribunal,we ONLY need KENYA.

"On Saturday the 23rd of this month as l read Saturday Nation newspaper, l came across a story done by Kwamchetsi about a lady whose nose and ears were chopped by her husband after a domestic quarrel. I was very disheartened and disturbed and was compiled to find out the details of the story and the state of that lady. I went to COVAW on Monday and spoke to one of the officers there by the name of Carol Waiganjo who gave me the shocking details of the battered lady. Sharon Chepkiru i(20yrs old) was brought to Nairobi 3 weeks ago from Kericho to Nereo Chepkorir to work for her as a househelp. Nereo was shocked to see the state that Sharon was in and kept her in her house until last week when she took her to COVAW to seek any assistance for Sharon, since she is in bad health and can’t even work and has nowhere else to go. From Carol’s interview with both Sharon and Nereo, Carol was able to establish that Sharon was battered by her husband in March last year. She was taken to Kericho general hospital by good Samaritans where they only gave her fast aid, the wounds have since healed, though she looks terrible and needs reconstructive surgery that will cost Ksh: 200,000 at Kenyatta hospital. She has lost her self esteem because she ties a head scarf quite low near her nose to hide the scars and she keeps looking down as she doesn’t want people looking at her, she doesn’t speak much as it was Nereo who was speaking for her. All she had to say to Carol was “Hi mambo tumezoea na ni kawaida” which means she as reconciled to domestic sexual violence and accepts it as normal. One question am left wondering is could it be that domestic violence in Kericho is more rampant? Sharon’s husband was arrested then and has since been released and he is a free man, probably now married to another woman who he is likely to assault or is already assaulting. Carol could only give me Nereo’s cell number to try reach Sharon, l have tried calling that number continuously but it’s off since yesterday. I will keep calling it till l find them and l also left my contact at COVAW just incase Nereo and Sharon shows up again. I will keep you all update on this case because l must see and find ways of helping Sharon. She also needs counseling. Anybody in this forum who can offer Sharon counseling services? I will also pick up Sharon’s husband case with FIDA to follow-up. Justice must prevail."

Kenya: Amnesty International calls for immediate investigation into execution-style killings of human rights activists

Amnesty International today called on the Kenyan government to investigate immediately yesterday’s execution-style killings of two human rights activists.

The two men were shot dead in their car while stopped in traffic in the centre of Nairobi. It appeared to be a coordinated ambush. At least two gunmen fled the scene, according to eyewitnesses.

Oscar Kamau Kingara and Paul Oulu both worked with the Oscar Foundation Free Legal Aid Clinic (the Oscar Foundation), campaigning against illegal killings by the police and for the police to respect human rights in their security operations against alleged members of the Mungiki – a government-banned group operating in parts of Nairobi and central Kenya.

The Oscar Foundation has filed complaints against the Kenyan government in court, and called for investigations into illegal killings by police of people suspected of being members of Mungiki.

“Kenya must not become a place where it is unsafe to be a human rights defender. The Kenyan authorities should make it clear that attacks against those who promote human rights are completely unacceptable and that anyone who carries out such attacks will be brought to justice.”

The shooting followed a live television broadcast of a statement by a government spokesperson, Alfred Mutua, stating: "Mungiki has an NGO by the name of Oscar Foundation, which they use to try and get funds from overseas.... It is a front so that they can be able to carry out their activities”.

“It is unacceptable for the Kenyan government to make statements suggesting that opposition to illegal killings by the police amounts to support for banned groups,” said Erwin van der Borght. “The government should make it clear that this is not the case, and pledge support and protection for anyone doing legitimate human rights work – even if it amounts to criticism of government practice.”

Amnesty International, the Kenyan National Commission on Human Rights and other Kenyan human rights organisations have documented the extra-judicial execution of hundreds of alleged Mungiki members by Kenyan security forces. On 27 February 2009, following a fact-finding mission in Kenya, the UN Special rapporteur on extra-judicial, arbitrary or summary executions issued a statement condemning these killings and calling for police perpetrators to be brought to justice. He also called for the resignation of the Police Commissioner and the Attorney-General of Kenya.

The Mungiki group is mainly active in Nairobi and parts of central Kenya. Group members say that they are guided by traditional religious and moral beliefs and the group claims to have a role in maintaining law and order and the running of the public transport industry in parts of Kenya.

Alleged members have demanded "protection fees" from owners of public service vehicles and been implicated in killings and the assault of members of the public.

Leaders of the group have publicly alleged that the group has tacit support from prominent government officials in the current and previous governments, but have so far not named any.

The previous government banned the group on 8 March 2002. At the time, the then-Commissioner of Police is reported to have categorized Mungiki as one of the "perpetrators of lawlessness and insecurity in the country. It is illegal and Kenyans are advised to keep away from them and their activities. Adherents to the group will be arrested and charged in court."

Guantanamo Review Fails to address key Human Rights issues

On 22 January 2009, President Barack Obama signed three executive orders on detentions and interrogations. One of them committed his administration to closing the detention facility at the US Naval Base in Guantánamo Bay within a year, and directed officials to conduct an immediate review of the cases of the approximately 240 detainees currently held there to determine what should happen to them. As part of the executive order, the Secretary of Defense was required to undertake an immediate review of the conditions of detention at Guantánamo. The review was made public in February 2009. Amnesty International noted that the review recommended increased socialization and recreational activities for detainees, including those held in the maximum security Camps 5 and 6. The review also reported that a new outdoor recreation area for group exercise and a classroom had recently been added to Camp 6 and that further modifications were underway to provide open communal living for some detainees. While such measures are long overdue, there is concern that many detainees may not have access to such "privileges" - the report made a distinction between "compliant” and "noncompliant" detainees of whom the latter could continue to be confined to cells for 22 hours a day. According to lawyers, most detainees in Camp 6 are still held in 22 hour cellular confinement in individual sealed cells with no window to the outside, in conditions Amnesty International believes flout international human rights standards for humane treatment

Hunger strike by Guantanamo detainee;Condition Worsens

The medical condition of Guantánamo detainee Ahmed Zuhair, who has been on hunger strike and a force feeding regime since 2005, has worsened. On a recent visit to meet him at the base, his US lawyers observed a marked deterioration in his health since they last met with him in mid-December.

According to his US lawyers in information recently filed in the US District Court for the District of Columbia (DC), when they met with Ahmed Zuhair on 11 and 12 February, he was shackled to a gurney (trolley stretcher) and was repeatedly given “large quantities of painkillers by medical personnel”. Guantánamo staff informed the lawyers that Ahmed Zuhair had recently suffered a fall in his cell. He was brought to the meetings, which were held in the base's Camp Echo, from the Detainee Hospital at Camp Delta.

The lawyers have said that his pain during their meetings with him was evident and that he could not sit up: “Even though Mr Zuhair was administered painkillers, any movement of the gurney caused him to wince in pain, and his own movements were slow and limited to slight gestures”. The lawyers have also reported that Zuhair’s weight was “perilously low”: “He appeared to weigh approximately 100 pounds, his biceps were roughly the thickness of his wrists, his eyes were sunken, and his cheekbones were sharp and gaunt. Mr Zuhair was considerably fatigued and unable to speak above a whisper for the entirety of the meeting.” Ahmed Zuhair’s own account of his condition and treatment remains classified.

In a separate development, his lawyers discovered on 21 January that Ahmed Zuhair has been approved for transfer from Guantánamo. They made the discovery by chance; the US authorities did not notify them. The government has now said that the approval for his transfer was made on 23 December 2008. The Guantánamo authorities notified Ahmed Zuhair on 10 February, on the eve of his meeting with his lawyers, that he had been authorized for transfer from Guantánamo. The written notice to him states that “while your transfer has been authorized, the date of such transfer depends on the United States reaching agreement with your country of origin or another country, to accept you”. The notice stated that “negotiating these agreements can in certain circumstances take considerable time”, adding that “although the United States will attempt to transfer you as soon as possible no date has been set for your transfer”. Other detainees have been held for years since their release from the base has been approved under the administrative review scheme. Ahmed Zuhair’s lawyers have said that he “affirmatively wishes to return to his family and homeland [Saudi Arabia], where he has never run afoul of the law”.

Ahmed Zuhair has been in detention for more than seven years without charge or trial. According to his 2008 petition for habeas corpus, in late December 2001 Ahmed Zuhair was seized in a market in Lahore, Pakistan, by a dozen men in civilian clothes. He was blindfolded and taken to a house in a residential area of Lahore, where, he said, he was tortured and otherwise ill-treated. In early January 2002, he was transferred to a military facility in the capital, Islamabad, and held incommunicado there for about 10 weeks: in mid-March 2002 he was handed over to US custody and held in Bagram air base in Afghanistan. In June 2002 he was transferred to detention in Kandahar, where he was held for two weeks. He said he was ill-treated in US custody in Afghanistan, including forced prolonged kneeling and stripping during interrogations. He was transported to Guantánamo in June 2002. Ahmed Zuhair began his hunger strike in mid- 2005, to protest at his indefinite detention without charge and the conditions in which he is detained. He has been force fed since August 2005.

Ahmed Zuhair’s lawyers filed an emergency motion in District Court in late November 2008 in relation to his deteriorating health. On 22 December, Judge Emmett Sullivan ordered the authorities to allow a court-appointed independent medical expert to examine Ahmed Zuhair. He also ordered the government to release Zuhair’s medical records to his lawyers. Judge Sullivan made the decision on the grounds that Zuhair must be medically fit enough to have “meaningful access to counsel”, and so that his lawyers “are able to adequately communicate with him” in his habeas corpus challenge. On 16 January 2009, Judge Sullivan appointed the independent expert suggested by Zuhair’s lawyers to conduct a “comprehensive medical and psychiatric evaluation” of Ahmed Zuhair, and ordered that she and an independent interpreter be provided transport to Guantánamo and access to the detainee, that she be given access to all Zuhair’s medical records and records relating to his force feeding, and allowed to speak with personnel at Guantánamo regarding Zuhair’s medical and mental health and the feeding process. No further details are publicly available.

On 23 January, around the seventh anniversary of Ahmed Zuhair being taken into US custody, his lawyers filed a petition pointing out that their client “continues to languish in Guantánamo Bay without charge, trial or due process” and with no “definitive judicial determination as to the legality of his detention”. They argued that the need for the “prompt habeas corpus hearing” ordered by the US Supreme Court’s Boumediene v. Bush ruling seven months earlier was “especially pressing as he nears the fourth anniversary of his hunger strike protesting his indefinite and arbitrary imprisonment”.

One of the orders required his administration to close the Guantánamo Bay detention facility “as soon as practicable” and to conduct a review of all the cases of detainees held there to decide what should happen to them. More than a month after a US federal judge ordered that Chadian national Mohammed el Gharani be released from the US detention facility at Guantánamo Bay in Cuba, he is still held there. Taken into custody when he was a child, he has spent nearly a third of his life in US military custody. He is alleged to have been ill-treated since the judicial order for his release was handed down. He has previously been ill-treated in Guantánamo in the context of interrogations to which he has been subjected.

Judge Richard Leon on the US District Court for the District of Columbia (DC) ordered on 14 January that Mohammed el Gharani’s detention was unlawful and that he should be immediately released. El Gharani, a Chadian national who was born and brought up in Saudi Arabia, has been held at Guantánamo as a so-called “enemy combatant” since February 2002. He was taken into custody by Pakistani forces in Pakistan in late 2001, at the age of 14, handed over to US authorities and taken to Kandahar air base in Afghanistan, before being transferred to Guantánamo.

Judge Leon ruled that the evidence against Mohammed el Gharani “consists principally of the statements made by two other detainees while incarcerated at Guantánamo Bay. Indeed, these statements are exclusively, or jointly, the only evidence offered by the Government to substantiate the majority of their allegations. In addition, unlike the other cases reviewed by this Court to date, the credibility and reliability of the detainees being relied upon by the Government has either been directly called into question by Government personnel or has been characterized by Government personnel as undetermined.” “Simply stated,” Judge Leon concluded, “a mosaic of tiles bearing images this murky reveals nothing about the petitioner with sufficient clarity, either individually or collectively, that can be relied upon by this Court.” He ordered the government “to take all necessary and appropriate diplomatic steps to facilitate his release forthwith,” (see USA: Judge orders release of detainee held in Guantánamo as child ‘enemy combatant’, 15 January 2009, http://www.amnesty.org/en/library/info/AMR51/006/2009/en).

Mohammed el Gharani is held in the harsh conditions of Camp 5 of the detention facility. Camp 5 was opened in 2004 as an isolation and interrogation facility in which detainees are held for up to 24 hours a day in small cells. Amnesty International understands that Mohammed el Gharani is being allowed out into Camp 5’s exercise yard for about two hours a day, during which time he is also alone.

It is alleged that Mohammed el Gharani was subjected to repeated beatings by Guantánamo Bay’s “Immediate Reaction Force” (IRF) following the order for his release last month. Over the years of the detention operations at Guantánamo, there have been consistent allegations of IRF teams using excessive force.

Mohamed el Gharani has previously been ill-treated in Guantánamo. Some details of this were revealed in a 2008 report by the Inspector General at the US Department of Justice. FBI agents described how in 2003, when still only 16 years old, el Gharani was “short-chained”: a chain round his waist was bolted to the floor, preventing him from standing up straight. He was left like this for several hours. Another FBI agent stated that a military interrogator had ordered guards to place Mohammed el Gharani in a “stress position,” described as being “shackled on the hands and feet and then chained to the floor to force him to sit on the floor or crouch without a chair.” Left like this for several hours, el Gharani was forced to urinate on himself. El Gharani himself told investigators of another occasion when military guards chained him overnight for 12 to 16 hours. The report also revealed that the teenager had been subjected to the “frequent flyer program” of disorientation and sleep disruption and deprivation that has been used against numerous detainees in Guantánamo (see USA: From ill-treatment to unfair trial. The case of Mohammed Jawad, child “enemy combatant,” August 2008, http://www.amnesty.org/en/library/info/AMR51/091/2008/en). Mohammed el Gharani has alleged that during interrogations in 2003, he was subjected to racist abuse, physical assaults, and doused with cold water.

BACKGROUND INFORMATION

Under international law and standards, detention and imprisonment of a child must be used only as a measure of last resort and for the shortest appropriate period of time. Every child deprived of liberty shall be treated with humanity and respect for the inherent dignity of the human person, and in a manner which takes into account the needs of persons of his or her age. Under international law, states must adhere to the principle that the best interests of the child are to be a primary consideration in all actions concerning children who come into conflict with the law. However, the USA’s treatment of children labelled as “enemy combatants” has been conducted in accordance with its own perceived national security interests rather than the best interests of the child.

On 22 January, President Obama signed three executive orders on detentions and interrogations (see: The promise of real change. President Obama’s executive orders on detentions and interrogations, 30 January 2009, http://www.amnesty.org/en/library/info/AMR51/015/2009/en).One of the orders required his administration to close the Guantánamo Bay detention facility “as soon as practicable” and to conduct a review of all the cases of detainees held there to decide what should happen to them.

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in your own words:

- expressing concern that Mohammed el Gharani is still detained in Guantánamo Bay, more than a month after District Court Judge Richard Leon ruled his detention unlawful and ordered his immediate release;

- expressing concern that Mohammed el Gharani is not only still in custody, but is being held in isolation in Camp 5;

- calling on the authorities to improve his conditions of detention immediately, give him increased time in the fresh air outside his cell and an end to his isolation, and allow him to telephone his family;

- expressing further concern at reports that he has been subjected to beatings by members of the Immediate Reaction Force, and calling for an investigation into these allegations and for the results to be made public;

- calling on the authorities to release him immediately to Saudi Arabia, where he resided and has immediate family, or, if this cannot be promptly arranged, to Chad, the country of his nationality, where he has extended family.

BINYAM MOHAMED: RELEASE AND ARRIVAL TO UK WELCOMED - INQUIRY URGED


Responding to the arrival at RAF Northolt of Binyam Mohamed upon his release today from Guantánamo Bay, Amnesty International welcomed his return but called for an independent inquiry into allegations that the UK colluded in his secret detention and torture.

The organisation also called on the UK authorities to make representations for the release or fair trial of other Guantánamo prisoners with links to the UK.


Amnesty International UK Director Kate Allen said:


“It’s a huge relief that Binyam Mohamed is finally back in the UK - his release hasn’t come a moment too soon.

“It’s nothing short of a disgrace that Binyam was held without trial for nearly years, having to resort to a hunger strike to raise awareness of his plight.


“The immediate focus should now be on providing medical and other support for Binyam on his return to the UK, but we also need a proper independent inquiry into Binyam’s case and allegations of a cover-up over torture, as well as into the wider practice of rendition and secret detention.


“The UK government should also now press for the release of Shaker Aamer and Ahmed Belbacha - two other men with longstanding links to the UK - and it should assist moves to close the camp by offering ‘humanitarian protection’ to vulnerable prisoners who need a place to go to.”


Amnesty International supporters have long campaigned for Binyam Mohamed and other prisoners at Guantánamo, including by sending hundreds of “greetings cards” to him and other prisoners.

However, Binyam’s US military lawyer Yvonne Bradley recently confirmed that he has had no correspondence delivered to his cell for nearly a year, with camp guards specifically denying him what they refer to as his “fan mail”. Binyam’s lawyer has described this manipulation of Binyam’s emotions as just one example of a battery of “psychological abuse” by guards in his case.


Some 240 prisoners are still held at the prison camp, with an estimated 50 currently on hunger strike - many being force-fed. Some 60 men are known to be at risk of torture or persecution if returned to their home countries, and while the US may permit some of the men to be admitted to the US mainland the remaining detainees are likely to need “humanitarian protection” in other countries upon release.

International community fails to protect Darfur

The Justice and Equality Movement (JEM) and the Sudanese government were reported to have struck an agreement on Monday that paves the way for Darfur peace talks. Amnesty International hopes the reported agreement marks a turning point in the human rights situation in Darfur. However, the organisation has demanded action, rather than words, to end six years of suffering for millions of Darfuris.The military strategy employed by all sides to the conflict in Darfur has left more than 300,000 people dead and more than 2.2 million displaced. Amnesty International has repeatedly urged all warring parties to stop targeting civilians.The deployment of peacekeeping troops by the UN more than one year ago has failed to improve the security of people in Darfur In a new report, Amnesty International has exposed the continuing crisis facing the people of Darfur and called for the joint United Nations-African Union peacekeeping force (UNAMID) to be provided with troops and essential resources, such as helicopters, that will enable it to fulfill its mandate. Despite the signing of the agreement the international community needs to redouble its efforts to protect the people of Darfur. “Promises made to the people of Darfur that they would be protected through the deployment of a peacekeeping force ring hollow; UNAMID remains chronically under-resourced and attacks against civilians, including killings, continue,” said Tawanda Hondora, Amnesty International’s Africa Deputy Programme Director. “Women are still exposed to rape and other acts of sexual violence. A climate of insecurity prevails and perpetrators act with impunity.” “The recent fighting in Muhajeriya is the latest in a series of clashes between government of Sudan forces and armed opposition groups, which led to the displacement of thousands of civilians and left scores dead.” Amnesty International has called on the UN Security Council to ensure UNAMID is provided with the essential resources that were pledged when UNAMID took over from the African Union Mission to Sudan (AMIS) at the end of 2007. “Words alone are not enough. It is of no use to deplore violence in Darfur and deploy a force that is under-equipped,” said Tawanda Hondora. “UNAMID must be enabled to protect itself as well as the people of Darfur. It is simply unacceptable that more than a year after the deployment of UNAMID, civilians still live in peril.” Amnesty International has called on countries that pledged troops and other essential personnel to UNAMID to ensure that they are adequately trained and promptly deployed to Darfur. It has also called on the wider international community, and particularly the country members of the Friends of UNAMID group, China, South Africa and Egypt, to use their influence and ensure that UNAMID is immediately provided with the military equipment it urgently requires. The USA, China, Russia, Japan, Australia, Egypt, South Africa and European Union countries, among others, have been urged to pledge and deliver helicopters and other essential military equipment to UNAMID.

New Zimbabwe government urged to prioritise human rights

Zimbabwe's new unified government has been urged to place human rights at the top of its agenda when it takes office this week.

Zimbabwe's President Robert Mugabe is due to sign into law a constitutional amendment allowing opposition leader Morgan Tsvangirai to become prime minister on Wednesday, paving the way for the men to share power.

Amnesty International has called on the new administration to follow its five-point human rights plan:

Release prisoners of conscience
The new government should immediately and unconditionally release Jestina Mukoko, Broderick Takawira, and Pascal Gonzo. It should also either promptly charge all political detainees with recognizable crimes, and ensure a prompt and fair trial for them, or release them immediately.

Provide access for human rights groups
The new government should commit itself to opening up the operational environment for all NGOs and human rights groups, political parties and independent media.

Deal with past human rights violations
The new government should publicly acknowledge all human rights violations by the previous government, commit to establishing the truth, and take effective measures to guarantee non-repetition.

Address impunity and policing
The new government should immediately end partisan policing and combat impunity for human rights violations by the security forces.

Tackle poverty
The new government should prioritise the full realisation of economic, social and cultural rights including rights to food, health, education and housing. Where it is unable to meet its minimum core obligations, it should seek international assistance.
"The inauguration of an inclusive government is an important opportunity for the ZANU-PF and the two formations of the MDC to demonstrate to the Zimbabwean people and rest of the world that they are committed to a future where human rights are truly and fully respected, protected, promoted and fulfilled," said Simeon Mawanza, Amnesty International’s Zimbabwe researcher.

The first 100 days of the new administration offers the chance for President Robert Mugabe and Prime Minister-designate Morgan Tsvangirai to take concrete steps to demonstrate the commitment of the new government to human rights.

President Obama ordered US military prosecutors in Guantanamo war crimes tribunals to halt pending cases for four months afew hours after taking office

The Council of Imams and Preachers of Kenya (CIPK) has welcomed US President Barack Obama’s suspension of prosecutions at the infamous Guantanamo Bay detention centre for 120 days.

The move is widely seen as an effort by the new Obama administration to review cases involving detainees at the cam

I believe Obama can regain seven years of lost ground on human rights

President Barrack Obama becomes the 44th President of the United states Of America.


On his shoulders,he is carrying a lot of responsibility which comes hand in hand with a lot of inherited troubles from the Bush Administration and other previous regimes.

Being an American President comes with a lot to do because it is the globe’s greatest empire with 745 military bases in 120 countries.


We have the Guantanamo Bay.

U.S. Naval Base Guantanamo Bay is the oldest U.S. base overseas and the only one in a Communist country. Located on the southeast corner of Cuba, in the Oriente Province, the base is about 400 air miles from Miami, Florida. The terrain and climate of Guantanamo Bay make it a haven for iguanas and banana rats.

In December 1903, the United States leased the 45 square miles of land and water for use as a coaling station. A treaty reaffirmed the lease in 1934 granting Cuba and her trading partners free access through the bay, payment of $2,000 in gold per year, equating to $4,085 today, and a requirement that both the U.S. and Cuba must mutually consent to terminate the lease.

Diplomatic relations with Cuba were cut in 1961 by President Dwight Eisenhower. At this time, many Cubans sought refuge on the base. U.S. Marines and Cuban militiamen began patrolling opposite sides of the base's 17.4 mile fenceline. Today, U.S. Marines and Cuba's "Frontier Brigade" still man fenceline posts 24 hours a day.


The present situation in Guantanamo bay does not reflect the original idea of its set up and that is why it should be closed,America should leave Guantanamo Bay.

We have the Africom Idea started by Bush.

On October 1, 2008 the Pentagon established Africom as the new US military body solely devoted to Africa. Africom ( the African Command ) has the promotion of stability as its primary goal, “to enhance our efforts to bring peace and security to the people of Africa” in Bush’s words.

The decision to establish the command was not requested by African leaders and only Liberia has offered a permanent headquarters. Consequently, Africom is currently exiled in Stuttgart, Germany.

A major campaign is waging in the US called “Resist Africom” and led by African Faith and Justice Network (www.afjn.org) who point out that the real aim of Africom is to give unprecedented access to the US military on the continent, while continuing its ideological war against terrorism and using soldiers to contain Chinese expansionist plans as well as securing oil supplies in Africa.

This is another field where Obama should be able to be wise and make the hard decisions of writting off some policies that had choking strings attached to them.


We have Afghanistan waiting.

This is more or less connected to the war in Iraq in terms of expenditure and man power loss.

Obama should stand out,and be above the obvious.


Lastly...


We have Osama on the loose.


Lets pray and Hope that Obama was built to counter Osama.

Many people had hopes that Tupac would return in 7 years. And that time has come and gone, and people still think he is alive. Below are some theories that people had/have or reasons he is, or could still possibly be alive. But people just want to hold on I guess. He is the black Elvis, and they don’t want to let go. Anyways, on to some of the theories: Keep in mind these theories are NOT written by me, but submitted to me. And do not reflect my views and/or opinions.

Later on in the hospital Tut called Pac and asked what he was still doing alive and said they would finishg the job. This is why Pac left the hospital so fast.

IF THE GOVERNMENT OF KENYA WANTS TO DISARM ITS NORTHERN KENYA CITIZENS,IT SHOULD BE READY TO GIVE THEM SECURITY.


In Kenya, the pastoralist communities occupy the largest percentage (over 70%) of the countries total land area. The population of the livestock keeping (pastoralist) communities in Kenya is estimated at about 20% of the total population of the country (i.e. about 6 million people out the total 30 million)1Most of these people occupy the vast Arid and Semi-Arid region of Northern Kenya. They keep cattle, camel, goat, sheep and donkeys.
The Northern Kenyan pastoralists are nomadic ethnic groups that are highly mobile. These are mainly Turkana, Samburu, Pokot, Borana, Rendille, Orma and Somali clans. They move from one area to another in search of pasture and water for their livestock. Their movements are not restricted to one area or even country as they move into and out of neighbouring countries such as Somalia, Ethiopia, Sudan and Uganda. These movements are one of the major sources of misunderstanding and conflict between them and their neighbours.
The region is highly marginalised and underdeveloped as essential infrastructure such as water, livestock market, health, roads and education facilities are either too scarce or totally absent to be relied on. The vastness and remoteness of the area, inadequate road networks and scarcity of resources goes hand-in-hand with lapse in security occasioning frequent misunderstanding and conflicts among these pastoralist communities. This is normally over resources especially water and grazing land.
The conflict situation in this area is further complicated by two major issues, the regional dimension (neighbouring with other countries of East and Horn of Africa); and most importantly easy availability and continuous in-flow of small arms and light weapons from these neighbouring states.
This is reason enough to protect those deemed to be defenseless and recently some kenyans were assaulted on the northern part because some of them lacked arms,this is so unfair and the Government should be ready to deploy the military to protect its people who don’t have arms because the same government is disarming them yet the people of the neighboring countries on the borders are armed and are a threat to the kenyans living on the borders.

The wife of Kenya's prime minister has turned down a controversial monthly allowance of $6,000 (£3,000) offered to her by the government.


Ida Odinga the wife of the prime minister of kenya thanked the state for appreciating her role, but said she did not need money for her legacy.
The decision to pay hefty salaries to the wives of the prime minister and vice-president provoked public outrage.Despite hosting many functions in the name of the govt,the premiers wife is not going to take the money and she promises that she will go on giving the people of Kenya her services irrespective of lack of a pay cheque.

Murungaru seeks to serve Githongo suit in the media


Former Internal Security minister Christopher Murungaru is seeking the court’s go-ahead to serve a defamation suit against Mr John Githongo through the media.
On Wednesday, Murungaru filed an application at the Nairobi Law Courts to be allowed to serve the former Ethics and Governance PS through Times of London, The Guardian, The Standard and Daily Nation.
He claimed attempts were made to serve Githongo at PCS Plaza, Strathmore University and Karen during his recent visit.
Murungaru is seeking to serve the former PS with the papers through substituted service because Githongo is out of the court’s jurisdiction.
He sued Githongo in 2006 for allegedly causing defamatory statements to be published against him in relation to the Anglo Leasing scandal.
When the case came up in May 2006, High Court Judge Festus Azangalala ordered the former PS, who was in a self-imposed exile, to be served with the suit papers in the UK. Then, he ordered that he enters appearance in Murungaru’s suit within 45 days.
The former minister claims Githongo’s statements, which were published on November 22, 2005, could be understood to mean he engaged in corrupt practices and lacked integrity.
The alleged defamatory words, he argues, through his lawyer Kioko Kilukumi, could also be construed to mean he obstructed the course of justice and interfered with investigation into corruption.
The words could also mean the former minister altered or caused to be altered a statement prepared by President Kibaki regarding reshuffle of Government officers, he claimed.
Murungaru pleaded his innocence, saying he was not corrupt and had not engaged in corrupt dealings.
He also denied participating in any botched attempt to demote Githongo.
He dismisses Githingo’s corruption report, saying it consists of “conjuncture, imaginative and creative journalism laced with a fair measure of malice”.
The timing of the publication (of the report) was calculated “to inflict maximum political damage to his political career and aid the British Government in its legal battle with the plaintiff over cancellation of the plaintiff’s visa,” his lawyer argues.

Undercover Kenya Wildlife Service (KWS) officers impounded a consignment of snakes, geckos and spiders that were being exported to Japan without valid export documents.
The seizure at the Moi International Airport, Mombasa took place on Wednesday.
The reptiles, which were in a package labelled “live animals”, were destined for an address in Tokyo, Japan. Inside the package were ten whip spiders, ten camel spiders, one Jackson tree snake, one olive marsh snake, five brown house snakes, one cape wolf snake, five flat-snouted wolf snakes, three forest wolf snakes, three East African shovel snout snakes and three tiger snakes among others.
I wonder whether this reptile trip was above board.

Then came the SABAOT LAND DEFENCE FORCE,
and things changed.
For a long time,the Sabaot Land Defence Force (SLDF) caused fear in the hearts of the people of Mt.Elgon a District in the Western province of Kenya,in response to that,the government deployed its forces to go and help save the situation because many people were being tortured and some killed by this illegal militia,the residents and the whole republic welcomed the move,little did they know that the saviours would also turn out to be SLDF-B,i say SLDF-B because the military and police used brutalety against innocent civilians.
“You should know that the police are beating people, even those who are innocent. Men are being beaten and theywill have pain for the rest of their lives, even after the SLDF and the police are gone. Most woundings and beatingscome from the police and I would like to ask them to stay but to stop harassing people. The police cannot discoverwho is causing the problems so they decided to harass everyone. So people can say who is the bad one. They saythat they will finish the violence like this. But land is the problem and if this is not solved then how are the peoplegoing to be able to stay?”these are not my words but are the words of a kopsiro District resident,this was then and now the police and even the military deny having violated rights of the people of mount Elgon,what pains most is the military instead of helping the police,it came with added brutality,as this man from kopsiro informed, “Ever since the military came, the situation has become quieter. The military are solving the problem in one way,but in another way, not at all. Now people are in the hospital or killed by the military. We worry because of themilitary now. They can just come, beat you and hurt you forever, even if you are an innocent person.”
To make matters worse again,though this was not official,the government through its arms announced a war on the NGOs that were against the brutality of the military,they have made operation hard for these NGOs with some even being denied room of operation.
For instance if they are not guilty or never used force,why did they go to the extend of even mishandling press men in there initial stages of the operation?
Or...
“We don’t have a clinic here. When the army came here, the staff of the health centre left to other places. Some of themwere even arrested and tortured. They were arrested because the army suspected the clinical staff of helping the SLDF.”
Why did they torture and even detain some medical staff in cheptais division with the excuse that the staff offered the SLDF help?isn’t the duty of a medic to help anyone in need of medical services irrespective of prevailing situations?
Recently the head of the Doctors Without Boundaries in Kenya said they had solid evidence that can prove the military and police used undue force when dealing with the people,in this evidence not even the police commissioner can escape,from this revelation i have come to learn that it was double tragedy for the residents of Mt.Elgon because at one point they had been hit very hard by the SLDF then the would be saviors too (military and police) added salt to there wounds by maiming and killing their sons and husbands.
It is the highest time the military and the police owned up to their wrongs.
And maybe they are waiting for the formation of commissions of inquiries to probe them first as it has been the order of the day.

When John MacCain said that he had not yet chosen his running mate,he was just being insincere because he wanted to make a suprise announcement,to me senator John MacCain is a man who is full of illusions.
Can you imagine that he chose Alaska Governor Sarah Palin as his running mate?
Let me tell you why i think MacCain is a sinking ship;1)He chose to pick Mrs.Palin so that he scores on gender points,to him he thinks that by not choosing Hillary Obama would get rebellion which he never got,so,MacCain wants to unearth a rebellion from the Democrat’s supporters because he wants to remind them that Hillary clinton was not chosen second by Obama.
This is a failed attempt on the onset because Hillary came to Obama’s team with all her ammunitions and therefore none was spared to be used by MacCain against Obama.

Balkans Crisis,Hurricane Gustav.... Even Nature Doesn't Want McCain Presidency


McCain might have potponed his party’s convention,or decided to delay its starting time due to fear of the Hurricane Gustav,If this was the case, then it would not be the first time that John McCain has had to alter his plans.
Back in 2000, McCain had to postpone his announcement to run for President as a result of the crisis in the Balkans.
And.......
The 2008 Republican National Convention is to take place at the Xcel Energy Center in Saint Paul, Minneapolis from September 1 until September 4,but unfortunate enough,when Sept 1 arrived,this hurricane Gustav came on the way.
At first it was the Balkanas crisis when he wanted to announce his interest for the presidency,this he postponed then now we have Hurricane Gustav,why can’t McCain see this and save his energy sooner than later?
It is either God doesn’t want grandpa to vie for that seat or it is just bad luck.
He himself said recently to his supporters “take off our Republican hats and put on our American hats” to me this he might be a good thing in two ways,he would be urging his supporters stop politicking and help save the situation or maybe he is calling it quits;telling the republicans that he would wish to stop running on the republican ticket (which actually may be the only way out)to me General McCain is one man who still has along way to go,he should have started by asking God first if it was good for him to run for presidency before announcing it in public,am sure he wouldn’t have met the Balkanas crisis or the Hurricane Gustav.

When Circumcision Is Not Initiation


The Luhya of western Kenya initiate their youth by circumcision, normally the initiation of the Luhya community of western Kenya always comes after every two years. This takes place every August and is usually flanked with alot of traditional practices. A Bukusu circumciser from Maliki village, in Webuye Bungoma Kenya.
This year 2008 happens to be year of this cultural event, we have seen alot of drama as these initiates pass through their rite, what started as a cultural event now has started taking a dimension that is not good,just yesterday, a man was forced to have a cut, this man who happens to come from a community that doesn’t embrace the cut was ambushed and circumcised, this is turning out to be the tradition since this act is still being carried.
Funny enough,When some are asked why they force people to have the cut against their will, they claim that it was the Prime minister who commissioned them.
This should be stopped because, for us to live well in society with our neighbors, we have to respect their cultures and traditions irrespective of how we perceive them.

01/09/2008 - At 10.00 am local time on Sunday, 31 August, fighting broke out in the Medina area of Mogadishu where some of the SOS families have been relocatedHearing the shooting SOS mother Fahamu hurried to get her children inside and in the process was hit by a stray bullet in the chest. She was assisted by another co-worker, but due to the heavy fighting it was 15 minutes before they could leave for the hospital.
Once there, an SOS youth leader donated blood and Fahamu underwent surgery on Sunday afternoon. She is now conscious and on the road to recovery. The Medina Hospital is an ICRC hospital in the south of Mogadishu. The SOS Hospital is in the north of the town and is often inaccessible due to a large military presence in the area.
The SOS families were evacuated from the SOS Children’s Village (which is just opposite the SOS Hospital) last December, after the village was hit by mortar fire and an SOS family assistant was killed.
In a separate incident a former SOS youth was shot dead last Thursday evening (28 August) in Afgoye, 22 km from Mogadishu. He was visiting an SOS satellite clinic at the time when he was approached by thieves who wanted to take his mobile phone. Resisting them, he was shot in the neck and died at the SOS clinic shortly afterwards. Alas was 26 and, following his disengagement from the children’s village, had been employed as a gardener at the SOS Hospital for two years.
The SOS Clinics in Mogadishu and in Afgoye offer essential medical care mainly for mothers and children

Descendants of the late Koitalel Arap Samoei (The Nandi Leader )son of Kimnyole who was killed by the British colonialists in 1905 have petitioned the government of Kenya to have his skull and other artefacts taken by the British returned back to them,the artefacts that have not been given back to them include;Koitalel’s traditional stool,his sandals and ornaments.This comes after they reclaimed some of Koitalel’s tools that had been taken by the British in 2004,among what they have since received is his two walking sticks.
In their quest for the property of their Legend they also want the government to help them complete the construction of a mausoleum in Nandi Hills Town in his rememberence.

I wonder why many politicians want to demonise the KNCHR over the issue of the figures behind the post election violence.
The very guilty of the imorality that rocked the country(politicians) want to attack an independent body that has been keeping them on check,for instance what is wrong with the commission if it has produced a list that is not similar to a previous one that was produced by them?Dont these politicians know that in life or in areas where reports are concerned we will always have a final copy that is reached from a series of investigations/dont they know for instance that he KNCHR must have done their homework for them to clarify the different names that were suspect?
It is highest time these hypocrites gave Mrs. Jaoko (KNCHR chairperson)a breathing space.

Kenya Govt Should Save Maasai Mara

Kenya’s iconic “Maasai Mara” is a crown jewel of Kenya’s tourism industry. It is a haven for migrating wildebeests that come rushing from the nearby nations and was recently considered as a world’s “seventh wonder.But the wildlife haven has seen a sharp reduction in the wildebeests because of over-grazing, farming and mass tourism.





Though, Maasai Mara national park is a protected area the ecosystem around it is privately owned.In 2000 the Kenya govt moved to subdivide land into small plots for Maasai families, the newly-acquired notion of land ownership has led to tensions between neighbors encroaching to find pasture for their livestock.
Whereas restricted for grazing in their shriveled estates, many Maasais opted for wheat farming or simply sold their plots to developers.And both outcomes contributed to choking the natural habitat of the lions and elephants so prized by the world’s tourists.
The Maasai had to make a choice because the pastoralist lifestyle was no longer sustainable.The wildlife has one of the best exotic products in the world and it firmly needs commercial and philanthropic models to make the conservancy viable.
It is high time the govt took serious measures to protect the vulnerable species in this park by protecting the park and its entire ecosystem.

you might be wondering what these names are for but if you will look at them keenly you will realize they are names of geographical regions around Kenya.

These are the Districts that were curved from existing ones by the KIBAKI administration in pre-poll times,these to my understanding were a political tool to win the votes of these specific regions despite the fact that this aim was not achieved.

BUT ..............

WHAT DO WE HAVE NOW?

after the commissioning of these Districts we can see anything to show for them,we don't see the required administrative structures that are supposed to be in these Districts and mark you it is now almost a year since some of them were formed.

My question is, WHEN WILL OUR LEADERS START BEING OBJECTIVE ABOUT WHAT SHOULD BE DONE FOR THE CITIZENS OF THE REPUBLIC OF KENYA?

KENYA TESTS POSITIVE FOR OIL BUT THE BIG TEST IS YET TO COME TO KENYA W HEN THE OIL HUNGRY STATES START MAKING THEIR BIDDINGS FOR THE CONTROL.


Having tested positive for oil,Kenya now enters the list of target countries in terms of prospects by the energy hungry nations.

On the list of energy hungry nations,we have USA and China,what we are yet to see is how this two key players will approach the oil issue in Kenya.

What i hope is that the Kenyan people will be given the say as far as exploiting the commodity is concerned.

And we pray that this discovery of oil does not divide Kenya as it has done to many Oil nations.

MARTHA KARUA DESERVES HER SPACE AND PACE,GO KARUA GO!!!

Before we went to the polls,we had three groups,the ODM,PNU and ODM-K.In what i have to say about Martha Karua i want to exempt the ODM because there is no one in ODM who is competing with Martha.

Iwant to remind some friends of mine alittle bit of history,during this time the PNU'S main objective was to unite as a party of political parties and help re-election of Mwai Kibaki;in my reasoning or the reasoning of the time PNU'S main Agenda was to sell Kibaki to the kenyans and this was evident when we came to party nominations,i remember that there almost occured a problem in the PNU concerning individual parties that had affiliation to Mwai Kibaki but never wanted to part with the identity of their respective parties,then it was agreed that the parties making PNU'S main goal,was to be together at the presidential level so as to fight for Kibaki but on matters of the constituency and civic leaders i understand it was agreed that parties will field their own candidates despite previous campaigns by George Nyamweya who was campaigning for a unilateral mode of nominations which required members either to run on a PNU ticket or forget headquater support (George Nyamwea happens to be on the same drive now though he was defeated by Karuas and Kombos)
In my reasoning PNU as a party had not been created in anticipation for 2012 but only 2007 and so after installing Mwai it was supposed to close shop.

WHY AM I SAYING ALL THIS?

I want to assume that now since the PNU achieved its goal of re-electing Mwai even if it was through a back door or so,it has achieved its goal and indeed those who are now crafting means of sustaining PNU are not genuine in their quest,they are simply being misused by a specific group which thinks it has a right to leadership in Kenya.

Its outright madharau for a loser in the previous election to come and start fighting the very people who fought for Kibaki to achieve power in whichever case.
That was for the PNU.

Now lets have a look at ODM-K.

In Kalonzo musyoka's persuit to get to a higher office more than that of the common minister that he used to be,he decided to break ranks with Agwambo so that he would have a higher bargaining power in the political market,what he deed thereafter was to court Mwai and make a private MOU which we saw although he kept denying that he had not met the then PNU aspirant for president. As time passed and we went to the polls actually the election placed him where he belonged and when the poll results were rejected by the Kenyans he was swift to declare his alliegence to Mwai by defending his presidency or his win for that matter in the scuffle at KICC,this he deed very fast so as to fulfill his promise to Mwai as before the polls and it did auger well for him because he was named Vice President (imagine taking Julia Ojiambo and Daniel Maanzo for a ride all that time) after taking up that office he was vocal in fighting against the ODM struggle and in so doing he was clearcutting his personality of a political materialist because in his campaign we had seen and heard how he was against working with Kibaki. (hypocricy indeed)

WHY THEN DID I BRING STIVO INTO THIS?

This man of Ukambani wants to make a living in spoilling for others,just wait and see how he plans to do that.

I HAVE COME FROM VERY FAR,NOW I WANT TO HIT ON THE NAIL:

Martha Karua was a major defence captain in the Kibaki troops when he was about to throw in the towel and concede defeat,during this time George Nyamweya was a loser somewhere in his constituency and was nursing the wounds inflicted to him by his constituent's votes,in this time he never was a challenge to anti-Kibaki forces,when i saw the other day on TV George Nyamweya giving an ultimatum to PNU affiliates either to comply with their plan to assimilate affiliates to one PNU party or face the axe from their respective constituency offices,i was wondering how on earth he would have the audacity to dare people who had been given a mandate by their constituents unlike him who was nominated to parliament,secondly i was astonished that he would do that even to those people who had fought for Kibaki to maintain his stay in office when he was almost shown the door!

you know sometimes people can play God and that is very very bad!!!

AND....

KALONZO MUSYOKA:
To me it seems that Kalonzo musyoka has already forgotten what he did to Raila,in PNU he was welcomed into the starting list of the game and now he wants to put the starting players on bench,when he came to ODM he wanted to replace Agwambo but the son of Oginga wouldn't allow that now he was invited as a guest into the PNU and now he thinks he can run the affairs of the party including choosing affiliation with specific people in preparation for a 2012 takeover.And in so doing he is repeating what he did in 2007.

UHURU KENYATTA :
To me it seems Jomo's son will never grow up,in 2002 Moi wanted to feed him on a silver spoon but it never was,in 2007 he was about to clearcut his role in kenyan politics when he was supporting ODM but he faltered that and to make it worse he spoilt the soup by resigning as the official leader of the opposition,this made him never to be trusted by kenyans because previosly kenyans thought he would wake up and rise against the tribal chains (if Uhuru would have stuck with ODM he would be a stronger figure because he would have risen from the tribalistic bracket and even the Rutos would be having a problem with him and something else KANU would be even stronger)
Then he joined Mwai with a hope of one day succeeding him,in this he was playing by the order set by Jommo kenyatta,Moi and even Mwai:the order of creaming leaders which will never be democratic.
AND now Uhuru still is waiting for an elders hand or even signal for him to behave like a grown up because he is still depending on the influence of his father and his father's friends and recently on that list we have president Kibaki.
FORGETING THAT NATURAL JUSTICE WILL ALWAYS CATCH UP WITH HIM.


Now all these people want to sit on Karua's head,to PUSH her down the table so that she isnt seen by the world.
I have a feeling that they have already coiled their tails because they know Martha not only has an appeal to the house of mumbi but also her record as the stern defender of Kibaki gave her credit long time back.

My advise to Martha is that never let anyone stop you even if you know your bid is alittle bit premature.


AND MY VERDICT:

1)Uhuru Kenyatta should grow up and start having personal drive instead of always waiting for somebody's back to use in climbing a wall.

2)Kalonzo Musyoka should go back to ukambani and work for his constituents because he hasn't done much for the people and he shouldn't forget that he is partly the reason why Kenyans died in the post poll era.

3) Nyamweya should shut up and try to work for his election to the August house instead of always waiting for nominations.

JUSTICE WAKI WE ARE WAITING FOR YOU.

All kenyans will be very happy when the Waki commission closes business with a report and recommendations that will give answers to the many questions that we have wanted to know all this time,major in the list being an explanation on why excessive force was used by police.


Despite the awaited results we are also waiting for transparency in their presantation and lastly we want to wait and see if the commission will fulfill its mandate or it will be just like all the inquiry commissions set up before because you know there is always a precedent.



We ask parliament to be vigil and make sure that all the results of the Krigler,Majid and Waki commissions be meaningful for their purpose........................
Then indeed Kenyans will be proud of the August house.

for kimunya to have said that the whole of the executive knew of the dealings at Grand regency is not a bad taste thing but for him to claim that that is the only reason for him to keep demanding for the residnition of thePM is not fair since the president too had prior knowledge of the events.
